Terms of Service

maketheir.day lets you build a private gift website for someone you care about. By using the service you agree to these terms. The short version: pay once, the site lives for a year, your words stay yours, and don't use it to hurt anyone.
Who we are
The service is operated by Beilo s.r.o., Company ID (IČO): 211 36 424, VAT ID (DIČ): CZ21136424, with its registered office at Obětí 6. května 554/4, Krč, 140 00 Prague 4, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, File No. C 396327 ("we", "us"). Contact: hello@maketheir.day. Beilo s.r.o. is the merchant of record for all payments, which are processed by Stripe.
The service
A gift is a single web page on a maketheir.day address you choose. You create it for free as a draft; publishing it requires a one-time payment of $9.99 (USD). Prices are final and include VAT where applicable. A published gift stays online for 12 months from publication and includes all sections, photo uploads, the countdown unlock, the optional secret word, and a printable PDF keepsake. There is no subscription and no automatic charge — we only ever charge you when you actively pay.
How the contract is formed
You configure your gift, review the address, unlock moment, and price in the publish step, and complete payment on a secure Stripe checkout page. Your order becomes binding when you confirm payment on that page; the contract is concluded the moment your payment succeeds, and we confirm it by email. The contract is concluded in English. You can review and change every detail of the gift before paying; after publication, editing follows the rules in "Editing after publication" below. These terms are always available at this address; please save a copy if you want the version you contracted under.
Drafts and addresses
- A draft softly reserves its address for 48 hours from the last edit. The reservation becomes permanent when you pay.
- Drafts untouched for 60 days are deleted, including uploaded photos.
- Addresses are unique per connector word; released addresses may be claimed by others.
Editing after publication
A gift is designed to open once, for one person, at one moment. That is an intended characteristic of the service and shapes what can change after you publish:
- The address is locked while the gift is live, so shared links and printed QR codes keep working.
- The unlock moment can be moved freely until it arrives. Once it arrives, it is permanent and cannot be changed or set again — not by editing, and not by a renewal. If you publish with an unlock moment in the past, the gift opens immediately and that moment is permanent from publication.
- Words and photos stay editable until 30 days after the unlock moment. After that the page is sealed: it stays online as a read-only keepsake, exactly as it was, for the rest of its paid period.
- The secret word can be reset or turned off at any time while the gift is live, and you can delete the gift at any time from the dashboard.
A renewal extends how long the page stays online on the same address; it does not re-open editing and does not change the unlock moment. These editing rules are part of what you buy — agreed characteristics of the digital content — and their effect is not a defect of the service.
Immediate delivery and your right of withdrawal
If you are a consumer in the EU, you normally have 14 days to withdraw from a distance contract. Your gift, however, is digital content delivered immediately: it goes live the moment payment succeeds. During checkout you therefore tick a box by which you expressly request immediate publication and acknowledge that you lose your 14-day right of withdrawal once the gift is published (Section 1837(l) of the Czech Civil Code). We confirm this consent in the purchase confirmation email. Publication — not the unlock moment you chose — is the moment of delivery.
A renewal extends your gift from the end of its current term. If you renew during the grace period, service resumes immediately. You may withdraw from a renewal within 14 days of paying it: if the renewal term has not yet begun, we refund it in full; if it has begun at your request (a grace-period renewal), we refund it reduced pro rata for the time already provided. To withdraw, email hello@maketheir.day with the gift address and the date of payment — no special form is required.
After the 12 months
When the paid period ends, the public page shows a neutral "this gift is sleeping" notice for a 30-day grace period, during which you can renew for another 12 months on the same address. After the grace period the photos and content are permanently deleted and the address is released.
Payments and refunds
Payments are processed by Stripe; we never see your card details. Beyond the withdrawal rights above, if something went wrong with your purchase — the gift never published, you were charged twice, anything of the kind — write to us and we will make it right: hello@maketheir.day. We're reasonable people.
Defects and complaints
We are responsible for the gift page conforming to what you bought, for the whole paid period (Sections 2389a et seq. of the Czech Civil Code on digital content). Conformity is assessed against these terms, including the editing rules above — a locked unlock moment or a sealed page is the service working as described, not a defect. If something is actually defective — the page won't load, photos disappear, the unlock doesn't fire — tell us at hello@maketheir.day. We will fix defects within a reasonable time; if a defect is material and we can't fix it, you may ask for a proportionate price reduction or withdraw from the contract. If you are a consumer, we will resolve your complaint within 30 days at the latest, and we'll confirm in writing when we received it and how it was handled. Your statutory rights remain unaffected by anything in these terms.
Your content
- Everything you write and upload remains yours. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and back up your content, solely to operate the service and only for as long as your content is on it.
- You must have the right to use the photos and texts you upload, including the consent of people depicted where required.
- Illegal content, harassment, hate, or sexual content involving minors is prohibited and will be removed without refund. Every gift page carries a report link; we review reports and may unpublish content. If we remove or block your content, we will tell you why, unless the law prevents us from doing so.
Liability
We run the service with care, but no online service is perfect. Nothing in these terms excludes or limits any right the law grants you as a consumer, or any liability that cannot be excluded under Czech law — including liability for harm caused intentionally or by gross negligence, or for harm to a person's natural rights. Otherwise, to the extent the law permits, our total liability is limited to the amount you paid us in the last 12 months. Content in gifts is created by their authors, and the author is responsible for it; we act as its hosting provider.
Suspension and termination
We may suspend or remove a gift, or close an account, for a serious or repeated breach of these terms — prohibited content above all. Where the breach caused the removal, the payment is not refunded. You can delete your account and any gift at any time from the dashboard.
Changes
We may update these terms, for example when the service or the law changes. Material changes will be announced by email to account holders at least 14 days before they take effect. If you don't agree with a change, you can stop using the service and delete your account; gifts already paid for stay governed by the terms you accepted at purchase for the rest of their paid period.
Governing law and disputes
These terms are governed by Czech law. If you are a consumer, you always keep the protection of the mandatory consumer rules of the country where you live, and nothing here limits your right to bring proceedings in your home courts where the law gives you that right.
If you are a consumer and we can't resolve a dispute between ourselves, you may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1, Czech Republic, coi.gov.cz, for out-of-court consumer dispute resolution (ADR). Consumers in other EU countries may also use the ADR body of their own country.
